Here’s a refined 2026 guide to help you understand real estate taxes, costs and timelines before you buy:

🔹 New Properties (First Sale from Developer)

– VAT (21%) is included in the listed price
– No transfer tax applies
– Some developers even cover notary fees
– 15 % down payment and payment plan 3/5y depending of contract without hidden costs and fees.

🔹 Annual Property Tax (2025)

– Ranges from 0.1%–1%, based on location
– Calculated on municipality-assessed value (lower than purchase price)
– Becomes official once the building is entered into the cadastre (~2 years after completion)
– Decrease over time, with the first year reflecting the highest rate
– Tax can be paid by user (not owner), if specified in the contract

🔹 Buying a Resale Property

– Transfer Tax (progressive structure):
– Up to €150,000 → 3% – €150K–€500K → €4,500 + 5%
– Over €500K → €22,000 + 6%
– Must be paid within 15 days of signing
– Late interest: 0.03% per day

🔹 Rental & Capital Gains Taxes

– Rental income: 15% on net income
– Capital gains: 15%, with exemptions for:
– Primary residence
– Transfers between immediate family
– Deductible improvement/acquisition costs

🔹 Inheritance Tax

– 0% for spouses, parents, children
– Low rates apply to extended family

🔹 Notary Fees (Regulated & Capped)

Fees are regulated by law, structured based on the property’s value and capped to protect buyers and sellers from excessive costs.

From €120,000 onward, every additional €15,000 in value increases the notary fee by €10.

🔒 Maximum Fee Limit: The law imposes a ceiling of €5,000, regardless of the property price. Notary fees cannot exceed this amount.

🔹 Additional Notes:

– Notary fees are separate from taxes and legal costs
– For new developments, some developers may cover notary fees as an incentive
– Two notary appointments are usually required:
1. To sign the purchase agreement
2. To confirm receipt of funds and complete title transfer (Unless the full amount is confirmed at the first meeting – then the deal can be closed the same day ).

🔹 Obligatory for Contract Signing: An official court translator must be present during the signing of the sales contract. This ensures full legal compliance and protects the buyer’s rights, especially when the contract is in Montenegrin and the buyer does not speak the language.

🔹 Cost Range: Certified translations and apostilles typically cost between €20 and €100, depending on the language .
